Is Narco-Analysis Test a violation of Human Rights ?

There are a lot of problems with Narco test. Firstly, it does not guarantee that whatever the person speaks is the truth, it's just his sub-conscious mind which is controlling him and in such a case even fantasies are spoken with the same intensity as any other thing and so in such a case, culling out a truthful statement from other is neither easy nor possible. Secondly, Article 20(3) of our constitution provides that no person should be forced to a witness against himself/herself, and if we go for narco test, then we do nothing but violate this important Fundamental Right of a citizen. Thirdly the dose may lead to death of a person also and so I am of the view that it is also as grave as third degree torture as in both the cases you make the person speak what you want and just because it does not leave any mark on the body of the accused does not mean its not torturing of the person. It has been held as rape of mind by the honorable Supreme Court in the case of Selvi also. In the end I would like to say that it is also a form of torture but only difference is that it has effect on mind and not body, and in my understanding I don't an act should not be treated as torture just because it leaves no marks on the body of the victim. And most importantly the veracity of the statements can not be relied upon so in such a scenario, it is nothing but a gross violation of Human Rights of Accused. And in the last, just because a person is accused, it does not mean he/she is not having Human Rights or Fundamental Rights.

narco analysis though is useful as a tool for investigation, it is violation human rights.. it is impinging on fundamental rights as well...

it is very hurting to know that people are using lethal drugs to kill somebody. hence in such cases narco test is the best means to identify the cause of death. let us take the latest case of fatima, the wife of former haryana minister who had been killed by giving pollonium as poison. thus narco test is must to carry out the investigations further as it provides a strong witness.

Now a days the crime incidents which takes place in world is so sophisticated, recent incident like Yassar Arafat's death through addition of Polonium which is under scrutiny , tends the Law and Order authority to use such latest techniques at least to track how the criminals have used S&T to cause harm to human kind. When the Criminals are getting so used to S&T for devastating effects its genuine that concerned authority uses such techniques to get the helm of the situation. Tit for Tat:)

As per our constitution a person can not be witness to self. So Narco-Analysis Test is violation of human rights.

I agree this test is violation to human rights as our constitution also approves that a person cannot be a witness to himself as well as scientifically it also proves that person can emit mix words of true and untrue. It believe its a waste of time and money. India should go for true and thorough investigation which requires true officers

it has no much deal with human rights but it should be taken on extreme cases there is no gurantee of results in Narco analysis and according to law it cannot be considered as a proof of crime.

Human Rights are there for humans not for those homosepians who are not human. They do things which is against the humanity and then claim that they are human. In cases of such people Narco Analysis is a very small things.

Of-course it's not the violation of the human rights, it is used in critical cases, solving big issues related either to nation or maybe a state or a person

Besides, it was not proven scientifically, in the present increasing crime rate and terrorism narco test analysis is the last tool for investigating agencies to get answers from the convicts. Moreover all this test will done by the experts only.

narco test analysis cannot be used as evidence in court of law,it provide help for solving many criminal cases..terrorists who kills people,drug smugglers deserve no mercy and it should be conducted to save others human rights..

The nacro-analysis test is taken in very serious conditions when the person in doubt does not help law or seems doubtful. It should be noted that this test is not taken normally. So i think it is not violation of Human rights. Afterall, helping the law is help to humanity.
