Freedom of expression and the injunction of lower courts
What does M.F Hussain, Salman Rushdie, and Perumul Murugun have in common? All of these artists have faced threat to freedom of expression from powerful sections who use administrative power and loopholes in judicial systems with impunity. Our culture breeds tolerance. A recent judgment by a Karnataka court against 27 news media organisations, both print and television, the court conveyed: “Hence defendants 2 to 28 are hereby restrained by order of temporary injunction from telecasting or publishing any defamatory and malicious visuals or report in their news channels/newspapers about any subsidiaries run by Plaintiff including Plaintiff pertaining to the project namely _____ in any manner till next date of hearing”. It is time for the Supreme Court to issue directory guidelines to the lower courts to help them understand the nuances of our culture.
